L’Oreal Squares Up To Ebay Once Again
The selling of L'Oreal products on the Ebay site is the issue that the consumer big player has a big problem with and is tackling the problem head on. L'Oreal has made claimes that the products on sale on the site have a high chance of being fake and therefore harmful to the companies brand image. The fact that the products on the site may have come from outside of the more controllable European market is another issue that was raised by L'Oreal. This issue particularly an issue for L'Oreal's perfume shop section
This is by no means the only time that these two power houses have conflicted. L'oreal does not have a great track record against Ebay, with the later being victorious in most previous battles. Recently Ebay won the battle in Belgium that L’Oreal brought to the table.
L'Oreal are by no means the only brand to questions Ebay's policies, with many taking issue with the way it is exploited. Ebay's attitude to sellers shifting branded goods on their site has been attacked by other brands previously including Rolex, Dell and Levis.
The courts face issues in the way they deal with this problem as the is previous disparity in the way they have handled previous claims from brands against Ebay. The courts have handled each case on its own factors and although potentially commendable, it is likely to cause more issues down the line as other companies can bring their unique cases to be judged time and again.
London's High Court is thought to be the battle ground for this particular case and L'Oreal are to use trademark infringement as their argument. Among the products that L’Oreal will cite are Lipstick, perfume samples, hair products and eye makeup. Ebay claimed that their service has to potential to launch and sustain brands and that they should be viewed as a beneficial resource, something that is likely to form the basis of their argument in the court room.
